User Generated Content Submissions - Terms and Conditions

In these Terms, the following words have the following meanings:

  • • Content means your selected social media content, including but not limited to text, photos, videos, social media handles and other materials.
  • • Consent means your agreement to allow lululemon to Use your Content on our Platforms, in line with these Terms.
  • • lululemon means lululemon athletica canada inc. and its affiliates, subsidiaries, and personnel (including but not limited to lululemon athletica UK ltd, lululemon athletica FR SARL, lululemon athletica spain slu, lululemon athletica DE GmbH, and lululemon athletica ch gmbh).
  • • Platform means lululemon’s social media accounts (including but not limited to Facebook, Instagram, TikTok, Snapchat, YouTube or X), sites, stores, applications, and other media formats.
  • • Terms means these terms and conditions.
  • • Use means any use, reproduce, edit, modify, distribute, display, perform, translate, and create derivative works from the Content.

 

References to “us”, “we” and “ours” shall mean lululemon.


Our agreement:



1. You agree that by affirmatively responding to a request from lululemon or on lululemon’s behalf, on social media or otherwise, indicating your agreement for lululemon to use your Content, you have provided your Consent, and you agree to be bound by these Terms.

2. By agreeing to these Terms, you grant lululemon a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, transferable right and license to Use your Content across the Platform at lululemon’s sole discretion, and you waive any further right of approval or attribution as the author or creator of such Content. 

3. You acknowledge and agree that under no circumstances will lululemon pay you, or any other third party, any royalties or compensation for the Use of your Content. 

4. You also agree that any Content submitted by you that includes feedback, ideas, comments, or suggestions is non-confidential, shall be owned by us (including all intellectual property rights and moral rights), and can be used as we see fit in our sole discretion (including but not limited to developing, improving, and manufacturing products). You have no right to review, approve or object to lululemon’s Use.

5. You acknowledge and agree that the Content may contain information about you or other individuals which could constitute personal data under applicable laws. By agreeing to these Terms you consent to lululemon processing any personal data in order to Use the Content, in any media worldwide in accordance with our Privacy Policy. We recommend that you do not agree to our Use of your Content where your Content contains personal data and/or without express permission from anyone else who may be identifiable in the Content.


Your promises to us:



1. By providing Consent, you represent and warrant that:

  • • you are at least 18 years old and have the legal capacity to agree to these Terms;
  • • the Content is your original work, you are the sole author and owner of the intellectual property rights in the Content and have the right to grant the license herein;
  • • the Content does not contain or disclose another person’s personal information; and
  • • Use of the Content will not infringe on the rights of, or cause injury to, any person or entity.

2. By providing Consent, you further agree to indemnify and hold lululemon harmless from all claims, liabilities, damages, losses, costs, expenses, or fees, including reasonable attorneys’ fees, arising out of your breach of these Terms, or Use of the Content, including for breach of intellectual property, data protection, privacy, image, performance, or publicity rights. Nothing in these Terms limits any liability which cannot be legally limited.


Removing your Content:



3. If you would like us to remove any of your submitted Content, you may request removal by sending an email to our Guest Education Centre at gec.emea@lululemon.com. Your email must include a request to remove Content, the social handle of the Content creator, and a link to the Content you want us to remove or a location description containing enough information for us to find the Content that you would like us to remove. 

4. Please understand that we might not be able to remove your Content from all locations. For example, other users may have shared your Content before removal, backups of Content may exist in other locations, or your Content might persist in our systems. 

5. Please also be aware that your Content may not be removed immediately – our teams are extremely busy and will action your request within a reasonable timeframe once it has been received.


General



6. Please review lululemon’s Privacy Policy and Terms of Use for full terms and conditions.

7. lululemon reserves the right to amend these Terms at any time at its sole discretion without warning. 

8. These Terms shall be governed by and construed in accordance with the laws of the country where you reside. The exclusive jurisdiction of the courts in the country where you reside shall apply.
